1. Booking and payment
A booking is final after written confirmation and payment of a 50% deposit. The remainder is due within 14 days after the shoot and in any case before the final files are released. All prices include VAT. If you do not pay on time, I first send a reminder with a new term of 14 days. After that I may charge statutory interest and the statutory collection costs.
2. Cancelling and rescheduling
Rescheduling due to illness or circumstances beyond your control is free of charge. If you cancel up to 14 days before the shoot, only the deposit is forfeited. After that, 50% of the package price is charged.
3. Arriving late
If you arrive late, the shoot shifts by at most 30 minutes within the planned session; missed time is not extended. A no-show without notice forfeits the deposit.
4. Illness or force majeure on my side
If I cannot photograph due to illness or force majeure, we schedule a new date free of charge. For a birth, the backup photographer steps in by agreement or you receive a full refund.
5. Outdoor shoots and locations
In bad weather we reschedule an outdoor shoot free of charge, in consultation. Any entrance or parking fees on location are for the client.
6. Birth photography
I am on call from week 37 until the birth. If the birth goes so fast that I cannot arrive in time, you only pay the on call fee of 50% of the package price. The remainder is refunded or converted into a newborn shoot. A false alarm is part of the journey: the first false call out is included. Every following false call out is charged at € 95 plus travel costs. A call out counts from the moment I am actually on my way; consulting by phone is always included without limit.
7. Delivery
You receive an online gallery with the edited photos within 3 to 4 weeks. The final high resolution files are released after full payment has been received. Unedited files (RAW) are never delivered. Files are kept for at least six months; within that period I redeliver free of charge. Please keep your own backup as well.
8. Complaints
Report any complaints about the delivery within 14 days of receiving it, and we will solve it together. After that the delivery is considered accepted.
9. Copyright and use
Copyright remains with Kyra Elgersma Photography. You receive a licence for unlimited private use, including printing and sharing. That licence takes effect once the full amount has been paid; until then the photos, including the previews in the gallery, may not be used, shared or published. If payment is still outstanding after a reminder, the licence lapses and I may use the photos for my portfolio, website and social media, as set out in the agreement. Commercial use requires written permission. Editing the photos, including filters, is not permitted.
10. Publication
Photos are only used for portfolio or social media with your written consent. This consent can be withdrawn at any time. The only exception is non-payment, as described in article 9.
11. Other photographers
During the session I am the only one photographing, even if guests bring a camera. That keeps the moments spontaneous and the end result consistent.
12. Safety and responsibility
I work exclusively with safe, natural poses, especially with newborns. Parents remain responsible for their child at all times during the shoot.
13. Style and result
You book based on my portfolio and style. I do my utmost to capture the most beautiful moments and poses, but no specific pose, photo or result can ever be guaranteed; photography depends on the moment, the light and the cooperation of whoever is in front of the camera. A difference in taste about the photos or the editing does not entitle you to a refund. If a shoot fails technically through my fault, it is redone free of charge or refunded.
14. Liability and law
Liability is limited to the invoice amount. In case of loss of images due to technical failure beyond my control, at most the amount paid is refunded. These terms are governed by Dutch law.
